The outcome
On 30 October 2026, Edelman J dismissed CZQL’s original-jurisdiction application under r 28.01.1(a) of the High Court Rules. The applicant had been deported to Fiji. His lawyers repeatedly reported difficulty obtaining instructions, and no meaningful progress followed for more than two years.
Why the delay mattered
The Court considered both the ability to prosecute within a reasonable period and the apparent merits. It inferred the proceeding would not be prosecuted within a reasonable time. At the limited level appropriate to this dismissal application, the proposed challenge did not appear to identify jurisdictional error. Costs were ordered against the applicant.
Practice implication
For offshore clients, establish reliable communication, document attempts to obtain instructions and respond to registry directions. An unresolved constitutional-writ application can still be dismissed. The relevant discussion is at [12]–[15]; dismissal for want of prosecution should not be described as a new merits determination of visa eligibility.
